Agreement to Terms
By accessing or using GTM Alpha services, you agree to be bound by these Terms of Service. If you disagree with any part, you may not access our services.
1. Definitions
- "Service" refers to GTM Alpha consulting services, MCP server, API, and website
- "User", "You" refers to individuals or entities using our Service
- "We", "Us", "Our" refers to GTM Alpha Consulting / Helix Consulting
- "Content" refers to analysis reports, recommendations, and materials provided
2. Services Offered
2.1 GTM Consulting Services
- Premium Audit ($1): EPIC framework analysis, digital audit, implementation roadmap
- MCP Tool Calling (FREE): Programmatic access to GTM analysis tools
- Strategic Partner ($300/hr): Dedicated consulting sessions
- Fractional Partner ($4,500/mo): Ongoing 1-year engagement program
- Enterprise Plan ($1,500/mo): Team licensing and unlimited consultations
2.2 MCP Server Access
The GTM Alpha MCP server provides AI assistant integration via Model Context Protocol. Usage is subject to:
- Fair use limitations (reasonable request volume)
- No automated scraping or abuse
- Attribution when sharing analysis results publicly
3. User Obligations
By using our services, you agree to:
- Provide accurate information for consultations
- Use services for lawful business purposes only
- Not attempt to reverse engineer, hack, or disrupt our systems
- Not resell or redistribute our analysis tools without permission
- Respect intellectual property rights
4. Intellectual Property
4.1 Our Content
GTM Alpha retains all rights to:
- EPIC Framework methodology
- Website content, design, and branding
- MCP server software and tools
- Analysis templates and frameworks
4.2 Your Content
You retain ownership of:
- Business information you provide
- Custom analysis reports generated for you
You grant us a limited license to use your information solely for providing services.
5. Payment Terms
- Payments processed securely via PayPal
- Prices displayed in USD unless otherwise stated
- Volume discounts: 5% for 3+ hours, 8% for 5+ hours (Strategic Partner)
- Recurring services: Quarterly (8% discount) or Annual (12% discount) billing available
5.1 Refund Policy
- Premium Audit: No refunds after report delivery
- Strategic Partner: Unused hours refundable within 30 days
- Fractional/Enterprise: Pro-rated refunds for early termination (30-day notice required)
6. Disclaimers
Important Disclaimer
GTM Alpha provides consulting advice and recommendations. We do not guarantee specific business outcomes, revenue increases, or market success. Results depend on many factors outside our control.
6.1 No Warranty
Services are provided "AS IS" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability or fitness for a particular purpose
- Accuracy or completeness of analysis
- Uninterrupted or error-free service
6.2 Consulting Nature
Our services are advisory in nature. You are responsible for:
- Evaluating and implementing recommendations
- Business decisions based on our analysis
- Verifying information relevant to your specific context
7. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability shall not exceed the amount you paid for services in the preceding 12 months
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- We are not liable for lost profits, data, or business opportunities
8. Indemnification
You agree to indemnify and hold harmless GTM Alpha, its affiliates, and Shashwat Ghosh from any claims, damages, or expenses arising from:
- Your use of our services
- Your violation of these terms
- Your violation of any third-party rights
9. Confidentiality
We treat your business information as confidential and will not disclose it to third parties except:
- With your consent
- As required by law
- To service providers under confidentiality obligations
10. Termination
- You may stop using our services at any time
- We may terminate or suspend access for violation of these terms
- Upon termination, you retain access to reports already delivered
11. Governing Law
These terms are governed by the laws of India. For international users:
- EU users retain their statutory rights under GDPR
- California users retain their rights under CCPA
Disputes shall be resolved through good-faith negotiation, then arbitration in Mumbai, India if necessary.
12. Changes to Terms
We may modify these terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified via email or website notice.
13. Severability
If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
